Terms and Conditions

Last Updated: April 2026

1. Introduction

Welcome to Sandy Shores Africa Safaris, accessible via
https://sandyshoresafricasafaris.com/.

These Terms and Conditions govern all safari bookings, travel services, and related engagements arranged through this website. They define the legal relationship between Sandy Shores Africa Safaris (“the Company”) and the client (“the Traveler”).

By accessing this website, requesting a quotation, or confirming a booking, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions in their entirety.

These Terms constitute a legally binding agreement, enforceable under applicable law, and apply to all services provided directly or through third-party suppliers.

2. Nature of Services and Role of the Company

Sandy Shores Africa Safaris operates as a tour operator and travel arranger, facilitating safari experiences, accommodation, transport, and related services.

In delivering these services:

  • The Company may act as a principal provider or as an agent for third-party suppliers (including lodges, airlines, and transport providers)
  • Contracts for certain services may exist directly between the Traveler and the respective supplier
  • The Company coordinates, manages, and oversees service delivery but does not control all third-party operations

Industry-wide, safari operators function within multi-supplier ecosystems, and liability is typically limited to coordination and facilitation rather than direct service execution.

3. Booking Process and Contract Formation

A booking is considered confirmed only when all the following conditions are met:

  • Receipt of the required deposit or full payment
  • Submission of accurate traveler details
  • Issuance of written confirmation by the Company

Upon confirmation:

  • A binding contract is formed
  • The Traveler becomes liable for full payment under these Terms
  • Cancellation policies immediately take effect

The Company reserves the right to decline any booking request prior to confirmation without obligation.

4. Payment Terms

4.1 Deposit Requirements

  • A deposit of 30%–50% of the total safari cost is required to secure a booking
  • Certain itineraries (luxury lodges, peak seasons) may require higher deposits or full prepayment

4.2 Balance Payment

  • Full payment must be completed 30 days prior to travel
  • Bookings made within 30 days require 100% upfront payment

4.3 Payment Methods

Accepted methods include:

  • Bank transfer (international or local)
  • Credit/Debit card payments
  • Mobile payment solutions (where applicable)

Secure payment processing and third-party gateways are standard industry practice to ensure data protection and transaction security.

4.4 Non-Payment Consequences

Failure to meet payment deadlines may result in:

  • Automatic cancellation of the booking
  • Forfeiture of any deposit paid
  • Release of reserved services

5. Pricing, Currency, and Adjustments

  • All prices are quoted in USD or KES, unless otherwise specified
  • Prices are subject to change prior to booking confirmation

After confirmation, price adjustments may occur only due to:

  • Government-imposed taxes or park fee changes
  • Currency fluctuations affecting supplier costs
  • Mandatory third-party rate adjustments

The Company reserves the right to pass on such increases where unavoidable.

6. Inclusions and Exclusions

6.1 Inclusions

Unless otherwise stated, safari packages typically include:

  • Accommodation as specified
  • Meals as per itinerary
  • Ground transport and game drives
  • Park and conservation fees
  • Professional driver-guide services

6.2 Exclusions

The following are generally excluded:

  • International and domestic flights
  • Visa and travel documentation fees
  • Travel insurance
  • Personal expenses (tips, beverages, laundry)
  • Optional excursions and upgrades

Clarity in inclusions and exclusions is essential in safari bookings due to varying supplier structures and cost components.

7. Cancellations and Refunds

7.1 Cancellation by the Traveler

All cancellations must be submitted in writing.

Standard refund structure:

  • 30+ days before travel: Partial refund (excluding deposit)
  • 15–30 days: Up to 50% refund
  • Less than 15 days: No refund

7.2 Supplier-Imposed Penalties

Certain services (lodges, flights) may be:

  • Non-refundable
  • Subject to stricter cancellation terms

Where supplier policies differ, the stricter policy applies, which is standard across the safari industry.

8. Amendments and Itinerary Changes

The Company reserves the right to modify itineraries due to:

  • Weather conditions
  • Wildlife movement
  • Operational or safety considerations
  • Supplier availability

Where changes are necessary:

  • Equivalent or superior alternatives will be provided where possible
  • No refunds shall be issued for reasonable substitutions

Safari travel is inherently dynamic, and flexibility is an operational necessity.

9. Cancellation or Changes by the Company

The Company may cancel or alter bookings due to:

  • Force majeure events
  • Insufficient participation
  • Safety concerns

In such cases, the Traveler may be offered:

  • An alternative itinerary
  • A travel credit
  • A partial or full refund (subject to supplier recoveries)

10. Travel Insurance

Comprehensive travel insurance is strongly recommended and should cover:

  • Medical emergencies
  • Trip cancellations and interruptions
  • Emergency evacuation
  • Loss of personal belongings

The Company shall not be liable for losses that could have been covered under insurance.

11. Client Responsibilities

Travelers are responsible for:

  • Valid passports (minimum 6 months validity)
  • Visa requirements and entry regulations
  • Health compliance (vaccinations, medications)
  • Providing accurate personal information

Failure to meet these requirements does not entitle the Traveler to refunds.

12. Health, Safety, and Risk Acknowledgment

Safari travel involves inherent risks, including:

  • Wildlife encounters
  • Remote environments
  • Limited medical access

By booking, the Traveler:

  • Accepts these risks voluntarily
  • Agrees to follow all safety instructions
  • Confirms fitness for travel

13. Limitation of Liability

To the fullest extent permitted by law, Sandy Shores Africa Safaris shall not be liable for:

  • Injury, illness, or death
  • Loss or damage of personal property
  • Delays, cancellations, or disruptions
  • Acts or omissions of third-party suppliers
  • Events beyond reasonable control

This aligns with standard industry practice where operators act as facilitators within a broader service ecosystem.

14. Force Majeure

The Company shall not be held liable for failure to perform obligations due to events beyond its control, including:

  • Natural disasters
  • Political instability
  • Government restrictions
  • Pandemics or health emergencies

15. Complaints and Dispute Resolution

  • Complaints must be reported immediately during the safari
  • Formal complaints must be submitted within 14 days after travel

The Company will make reasonable efforts to resolve disputes promptly and fairly.

16. Media and Marketing Use

The Company may use photographs or videos taken during safaris for marketing purposes.

Clients may opt out by providing written notice prior to travel.

17. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Kenya.

Any disputes arising shall be subject to the jurisdiction of Kenyan courts.
